​# Terms of Service for Mythic Lair

These Terms of Service ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you" or "User"), and Mythic Lair ("we," "us," or "our"), concerning your access to and use of the Mythic Lair website (the "Site"), as well as any related services, features, or content offered through the Site, including the purchase of products (collectively, the "Services").
By accessing or using the Services, or by placing an order for products, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Services or purchase any products.
## 1. Acceptance of Terms
Your continued use of the Services constitutes acceptance of these Terms and any future modifications. We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use after changes indicates acceptance of the updated Terms.
## 2. Eligibility
You must be at least 13 years of age to use the Services. If you are under 18, you must have permission from a parent or legal guardian. By using the Services or purchasing products, you represent that you meet these eligibility requirements and are legally capable of entering into binding contracts.
## 3. User Accounts
If the Services require account creation, you agree to provide accurate information and maintain the security of your account. You are responsible for all activities under your account. Notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts for violations of these Terms.
## 4. Products and Orders
### 4.1 Product Information
We strive to display accurate product descriptions, images, prices, and availability. However, errors may occur, and we do not warrant that product information is complete, accurate, reliable, or current. We reserve the right to correct errors, change or update information, discontinue products, or limit quantities at any time without notice.
### 4.2 Ordering
By placing an order, you make an offer to purchase products subject to these Terms. We may accept or reject any order at our discretion (e.g., due to availability, pricing errors, or suspected fraud). Orders are not binding until we confirm shipment. You warrant that all information provided is accurate.
### 4.3 Prices and Payment
Prices are as displayed on the Site and may change without notice. You agree to pay all charges, including applicable taxes and shipping fees. Payment must be made via accepted methods at checkout. We use third-party processors and are not responsible for their errors.
### 4.4 Shipping and Delivery
Products will be shipped to the address provided. Delivery times are estimates only. Risk of loss passes to you upon delivery to the carrier. We are not liable for delays or losses caused by carriers or events beyond our control.
### 4.5 Returns, Refunds, and Exchanges
You may return most new, unopened items sold and fulfilled by Mythic Lair within 30 days of delivery for a full refund. We'll also pay the return shipping costs if the return is a result of our error (you received an incorrect or defective item, etc.). Note that this does not apply to pre-orders.
Pre-orders and Event Tickets are non-refundable.
If you decide to cancel an order, a 15% fee restocking fee will be applied to the refund amount.
Refunds are requested after we receive and process your return. You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request. We'll notify you via e-mail of your refund once we've received and processed the returned item.
Note: Due to the constantly changing price of singles, we do not accept returns, cancellation and refunds on single cards.
## 5. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:
- Violating any applicable laws or regulations.
- Infringing on intellectual property rights.
- Posting harmful, abusive, defamatory, obscene, or harassing content.
- Transmitting viruses, malware, or disruptive code.
- Interfering with the Services or other users' access.
- Attempting to gain unauthorized access to the Services or related systems.
We reserve the right to monitor activity and remove content or suspend access for violations.
## 6. Intellectual Property
The Services, including all content, features, and functionality (such as text, graphics, logos, and software), are owned by Mythic Lair or its licensors and protected by copyright, trademark, and other laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes (except for purchasing products). No other rights are granted.
User-generated content (if applicable) remains your property, but you grant us a worldwide, royalty-free license to use, modify, and display it in connection with the Services.
## 7. Third-Party Links and Content
The Services may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of these third parties. You access them at your own risk.
## 8. Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or free from viruses, or that products will meet your expectations.
## 9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTHIC LAIR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE RELEVANT PRODUCTS OR SERVICES IN THE PAST 12 MONTHS.
## 10. Termination
We may terminate or suspend your access to the Services at any time, without notice, for any reason, including violations of these Terms.
Upon termination, your right to use the Services ceases immediately.
## 11. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Canada.
## 12. Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
